Terms of Use

1. Agreement

These terms govern Mischi (the app) and mischi.app (the website). The website download form asks you to expressly agree to these terms before downloading. If you do not agree, do not download, install or use the app. If you use Mischi on behalf of an organisation, you confirm you are authorised to accept these terms for it. Our Privacy Policy explains how we handle personal data; acknowledging it is not consent to optional analytics or marketing.

Mischi is an independent project operated by ARJUN NV (@ajjuism), based in Kerala, India (we, us). Mischi is a project name, not an incorporated company.

2. Beta software

Mischi is in public beta. It works, but it’s still under active development: it may contain bugs, behave differently from one version to the next, and occasionally need its settings reset after an update. Keep your own copies of any pets you create. Please report problems when you find them.

3. Your licence to use Mischi

Mischi is free. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on Macs you own or control, for personal use or internal business use.

You may not:

• sell, rent, sublicense or redistribute the app, or host the installer anywhere other than by linking to mischi.app;
• modify the app, or reverse engineer, decompile or disassemble it, except to the extent the law expressly allows despite this restriction;
• remove or alter its code signature, notarisation, copyright notices or branding;
• use the app to build a competing product, or to extract bundled artwork for use elsewhere.

4. What we own

The app, the website, and everything in them, including the Mischi name, logo, bundled pet artwork, text, videos and design, belong to us or our licensors and are protected by intellectual property laws. These terms don’t transfer any ownership to you. All rights not expressly granted are reserved.

5. Your pets and content

Pets, spritesheets, character descriptions, chat lines, reminders and notes you create or import are yours. They stay on your Mac, and Mischi never uploads them to us.

If you import pets made by someone else, you’re responsible for making sure you have the right to use them. Mischi does not review imported files.

6. AI features

AI features are optional and only work with your own Groq API key. By using them you also agree to Groq’s terms and acceptable use policy, and you’re responsible for any charges on your Groq account.

• AI output can be wrong. Replies are generated by third-party models and may be inaccurate, incomplete, or inappropriate. Don’t rely on them for medical, legal, financial, safety or other important decisions.
• Ask Mischi takes actions. At your request it can take screenshots, read your clipboard, add reminders, save notes, open apps and websites, and start web searches. It decides which tool to use from what you ask, and it can misunderstand. You’re responsible for the requests you make and for checking the results.
• Mind what you share. Whatever you type or say, and anything a tool reads for you (such as clipboard text), is sent to Groq to produce an answer. Don’t ask Mischi about passwords, secrets or other people’s personal data.

7. Third parties and trademarks

Mischi works with services and formats from other companies, such as Groq for AI and the OpenAI Codex pet format. We don’t control those services and aren’t responsible for them. Mischi is an independent project and is not affiliated with, sponsored by, or endorsed by OpenAI, Groq or Apple. Codex, Groq, Apple, Mac and macOS are trademarks of their respective owners.

Links on the website to other sites, such as Buy Me a Coffee, X or Groq, are provided for convenience. Their own terms and policies apply.

8. Acceptable use

Don’t use the app or the website to:

• break the law or infringe anyone’s rights, including intellectual property and privacy rights;
• harass, deceive or harm anyone, or create or share unlawful content;
• interfere with the website, including overloading, probing or scraping it, abusing the newsletter or contact forms, or trying to bypass their limits.

9. Feedback

If you send us bug reports, ideas or other feedback, you allow us to use them to improve Mischi, without any obligation to you. We’ll handle any personal information in your message according to our Privacy Policy.

10. Updates and availability

We may release new versions, change or remove features, or stop offering Mischi at any time. We aren’t obliged to provide updates, support or maintenance. The app doesn’t update itself: installing a new version is up to you.

11. Ending this agreement

You can stop using Mischi at any time by deleting it. Your licence ends automatically if you breach these terms; if that happens, you must stop using the app and delete it. Sections 4, 5, 7 and 9 through 15 survive the end of this agreement.

12. No warranty

To the fullest extent the law allows, the app and the website are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation. We don’t promise that Mischi will work on every Mac or macOS version, meet your needs, be free of bugs, or keep your data safe from loss.

13. Limitation of liability

To the fullest extent the law allows, we won’t be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, revenue, goodwill or productivity, arising from or related to the app, the website, AI output, actions taken by the app at your request, or these terms, even if we were told such damages were possible.

To the fullest extent the law allows, our total liability for all claims related to the app, the website or these terms will not exceed the amount you paid us for the app, if any.

14. Indemnity

To the extent the law allows, you agree to cover any claims, losses and reasonable costs we face because you misused the app or the website, broke these terms, or infringed someone else’s rights.

15. Legal bits

• Your rights as a consumer. Some places don’t allow certain warranty exclusions or liability limits. Nothing in these terms limits rights you have under laws that can’t be waived by contract.
• Governing law. These terms are governed by the laws of India. The courts in Kerala, India have exclusive jurisdiction over any dispute arising from or related to them. If you use Mischi as a consumer, this doesn’t take away the protection of mandatory laws where you live.
• Severability. If part of these terms is found unenforceable, that part is limited as little as needed and the rest stays in effect.
• No waiver. If we don’t enforce a term straight away, we haven’t given up the right to enforce it later.
• Assignment. You can’t transfer these terms to anyone else. We may transfer them, for example if the project changes hands.
• Entire agreement. These terms and the Privacy Policy are the whole agreement between you and us about Mischi.

16. Changes to these terms

We may update these terms. When we do, we’ll change the date at the top of this page, and for significant changes we’ll give notice on this website. If you keep using Mischi after an update takes effect, you accept the updated terms.
